
Terms and Conditions
- Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.
- Entry is open to residents of New Zealand. Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this competition and their immediate families are ineligible to enter.
- The promotion commences at 7am on Monday 20th September 2010 & closes at 10pm on Sunday 26th September 2010 (“Promotion Period”).
- An “Eligible Purchase” requires the purchase of any 3 MILKYBAR products in a single transaction.
- To be automatically entered into the prize draw, make an Eligible Purchase from a participating New World Lower North Island supermarket where this promotion is displayed and present your Fly Buys Card to the checkout operator (or swipe your Fly Buys Card at the self scanning checkout when prompted when completing a purchase).
- Entry is not limited and an entry will be awarded for every Eligible Purchase made during the Promotion Period. (For example, if 6 MILKYBAR products are purchased at the same time, the entrant will receive 2 entries in the prize draw.)
- The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any individual entrant or group of entrants for tampering with the entry process, including but not limited to making multiple entries that are not associated with a separate Eligible Purchase, or for submitting an entry which is not in accordance with these conditions of entry.
- Prize is a MILKYBAR branded play tent valued at $110 recommended retail price (“RRP”). The tent features include mesh windows and ventilation top panels, a tunnel port with roll up flaps that secure with Velcro. The prize is supplied in a carry bag and with PE coated fibre-glass shock-corded poles. The prize measures 147.3cm x 121.9cm and is 147.3cm high (58” x 48” x 58”). There are a total of 92 prizes to be awarded (i.e. 2 prizes per supermarket)
- All valid entries received during the Promotion Period will be entered in the prize draw for the supermarket where the Eligible Purchase was made.
- There will be a prize draw conducted for each participating supermarket on Friday15th October 2010 at the offices of Fly Buys (Loyalty NZ) in Wellington. The first 2 valid entries drawn from the entries received in each of the participating New World South Island supermarkets will each win a prize.
- All winners will be notified by mail or a phone call made by Fly Buys New Zealand after the prize draw and the winners’ names and towns will appear at www.nestle.co.nz/whatsnew
- Prizes are not transferable & cannot be taken as cash, unless otherwise stipulated.
- Prize value is correct at time of printing but no responsibility is accepted for any variation in the value of the prize.
- The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.
- Each entry becomes the property of the Promoter. All details will be held in accordance with the Nestlé Privacy Policy which can be accessed by visiting www.nestle.co.nz or calling 0800 830 840.
- Promoter’s decision is final and no correspondence will be entered into.
- Prizes will only be delivered in New Zealand and each winner should allow 28 days from the prize draw for delivery of their prize.
- The Promoter is not responsible for any entries that are late, misdirected or lost and takes no responsibility for any entries not lodged correctly through the Fly Buys system or if the winner cannot be contacted due to incorrect or outdated contact details being recorded on the Fly Buys system. Entrants should ensure that their personal details on the Fly Buys database are correct. In the event a winner cannot be contacted, the prize will be redrawn.
- If for any reason this Promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant regulatory authority), to cancel, terminate, modify or suspend the Promotion. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.
- Entries are deemed to be received at the time of receipt into the Loyalty NZ database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.
