Terms and Conditions
Promoter
1. Foodstuffs (N.Z.) Limited (Foodstuffs) is the promoter of the New World Christmas Scratch & Win Promotion (Promotion).
2. By participating in this Promotion, you agree to these terms and conditions.
Promotion Period
3. The Promotion runs from 12pm 9 December 2024 – 11.59pm 22 December 2024, excluding the time between the First Entry Period and Second Entry Period as detailed in clause 4 (Promotion Period).
How to Play
4. To enter, eligible participants (as detailed in clause 12) must go to the New World mobile application and follow the prompts to the Christmas game promotion. You will then be presented with a “Scratch & Win” game. You have two opportunities to play the game during the Promotion Period. Eligible entrants are eligible to play the game:
a. once from 12pm 9 December 2024 – 11.59pm 15 December 2024 (First Entry Period); and
b. once from 12pm 16 December 2024 – 11.59pm 22 December 2024 (Second Entry Period).
(each, an Entry Period.)
5. The game must be completed during the First Entry Period or Second Entry Period (as applicable) to be eligible to enter the draw.
6. The object of each game is to reveal 3 identical symbols in a vertical row. To play the game, you must “scratch” off and uncover the 3 symbols to see whether you have won a prize.
7.Entrants who reveal 3 identical symbols in a row will immediately be notified they have won 5 New World Dollars (each a Prize).
8.Entrants who do not reveal 3 identical symbols in a row will not win a Prize and will receive a message stating “Better luck next time”. For the sake of clarity, the winning/losing algorithm of the “Scratch & Win” game will be based on a set percentage win rate applicable to each Entry Period. (i.e. winning is based on chance and not the application of skill). The chance of winning depends on the number of participants in the Promotion.
Prizes
9. Prizes totalling up to $300,000 NZD worth of New World Dollars are available to be won across the full duration of the Promotion Period. There are two separate prize draws during the Promotion Period:
a. Up to 30,000 Prizes will be drawn from all eligible entries received during the First Entry Period (with a total value of up to $150,000 NZD worth of New World Dollars); and
b. Up to 30,000 Prizes will be drawn from all eligible entries received during the Second Entry Period (with a total value of up to $150,000 NZD worth of New World Dollars).
10. There are up to 60,000 Prizes to be won in total across the full duration of the Promotion Period. Please note that at the time you enter the Promotion some prizes may have already been won.
11. Each Prize will be automatically loaded to the winners New World Clubcard account.
Eligibility to Enter and to Win a Prize
12. To be eligible to win a Prize you:
a. must be a current New World Dollars earning Clubcard member at the commencement of the applicable Entry Period. To avoid doubt, Airpoints earning Clubcard members are not eligible to enter and/or win a Prize;
b. must have downloaded the New World mobile application at the commencement of the applicable Entry Period;
c. must be a New Zealand resident and 18 years of age or older;
d. must consent to Foodstuffs using your name, photo, hometown and image for publicity and promotional purposes (including the display of your name in store) and you must make yourself available for publicity photographs relating to the competition on request for no additional compensation.
Verifying compliance with these terms
13. Foodstuffs and/or its agents reserve the right, at any time, to verify the identity of any entrant (including an entrant's identity, age, city/town of residence and place of employment) and to verify the validity of entries and to disqualify any entry or refuse to award a prize where false or misleading details have been given by an entrant, or an entrant has behaved in a fraudulent or dishonest manner calculated to jeopardise fair and proper conduct of the Promotion, or otherwise than in accordance with these Terms and Conditions. Errors and omissions may be accepted at Foodstuffs’ discretion. Failure by Foodstuffs to enforce any or its rights at any stage does not constitute a waiver of those rights. Foodstuffs’ legal rights to recover damages or other compensation from such an offender are reserved.
Exclusion of liability
14. Subject to any applicable laws which cannot be excluded, Foodstuffs and each New World store, their respective employees and agents:
a. assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to alteration of entries;
b. will not be liable for any loss, damage or injury of any nature incurred or suffered by any person (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with this Promotion; and
15. Foodstuffs may, in its sole discretion, refuse to award a Prize if it believes that a customer has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these terms and conditions.
Disputes
16. In the event of a dispute concerning any aspect of the promotion the decision of Foodstuffs and its agents will be final. No correspondence concerning any decision made by Foodstuffs or its agents will be entered into.
Additional terms
17. In addition to these terms and conditions, New World Clubcard terms and conditions and the New World mobile application end user licence agreement (in the ‘Legal’ section of the mobile application) will also apply.
18. Foodstuffs reserves the right to modify, suspend or terminate this Promotion or these terms and conditions at any time.
19. Foodstuffs reserves the right to substitute a Prize in whole (or in part) with a substitute prize of equal or greater value.
20. Prizes are not transferable, exchangeable or negotiable and are not redeemable for cash.
Privacy
21. All entries remain the property of Foodstuffs. Your personal information may be used to conduct this competition and for future promotional and publicity purposes in relation to this competition. By entering this competition, you consent to the use of your personal information for these purposes. Foodstuffs’ New World Privacy Policy will apply to all personal information that we collect from you.
