Terms and conditions of the “Depend Money Back Satisfaction Guarantee” New Zealand offer 

(Terms and Conditions)

1. Information on how to claim the “Depend Money Back Guarantee” offer (Offer) and the refund form part of these Terms and Conditions.  By participating in the Offer, you accept these Terms and Conditions.

2. The Promoter is Kimberly-Clark Australia Pty Ltd trading as Kimberly-Clark New Zealand (NZBN: 9429039095763), Level 2/123 Carlton Gore Road, Newmarket, Auckland 1023, New Zealand, Tel: 0800 447 814

3. This Offer is only open to New Zealand residents who are aged 18 years or over (Claimant) who submit a valid claim in accordance with these Terms and Conditions. 

4. Limit of one (1) claim per Qualifying Purchase and per person across all Eligible Products (defined below). 

Employees of the Promoter and their immediate families, participating retailers and agencies associated with this Offer are ineligible to claim.  Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

5. Offer opens for purchases on 01/04/2025 and closes for purchases at close of business on 31/05/2025 (“Purchase Period”). Claims open at 9:00am NZDT on 01/04/2025 and close at 11:59pm NZST on 31/05/2025 (“Claim Period”). 

6. To be eligible to claim your money back, individuals must purchase an Eligible Product (defined below) from a participating retailer during the Purchase Period (“Qualifying Purchase”). For the purposes of this offer, a participating retailer will be any store in New Zealand which stocks Depend products (including online retailers) and displays material advertising the Offer during the Purchase Period (“Participating Retailer”).  

7. “Eligible Products” are as follows:

Claiming Process 

8. To be eligible to claim for a refund, Claimants must, during the Claim Period:

a) Purchase any Eligible Product during the Purchase Period from a Participating Retailer and retain purchase receipt; 

b) Go to www.dependmoneyback.co.nz and enter: 

a. Name and contact details; 
b. Product purchased; and
c. Purchase price; and 
d. Photo of the purchase receipt (clearly showing store of purchase, date of purchase and details of Eligible Product purchased; and
e. Explanation of what they didn’t like about the purchased Eligible Product (minimum 15-words); and 
f. any other relevant information requested.

c) Submit the fully completed claim form. (Claim

The refund offer is only available until 11:59pm NZST on 31/05/2025 or until a maximum of 200 valid refund requests have been received, whichever is first to occur. 

9. Claimants must retain their original purchase receipt and the Eligible Product packaging as proof of purchase and for the purposes of submitting a Claim. Failure to produce the purchase receipt and packaging as proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of a Claimant’s Claim and forfeiture of any right to a refund under this Offer. The purchase receipt must clearly specify the retailer of purchase and that the purchase was made during the Purchase Period but prior to submitting a Claim. 

10. The Promoter reserves the right, at any time, to verify the validity of Claims and Claimants (including a Claimant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any Claimant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the offer. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. 

11. Claims will be processed by Greeneagle Distribution and Fulfilment, Unit 5, 9 Fitzpatrick Street, Revesby, NSW, 2212, Australia

Refund Process 

12. Refunds will only be issued once the Promoter receives and validates a completed Claim. 

13. When a Claim has been validated, Claimants will be contacted via email within 10-business days to provide their bank account details. Refunds will be issued by EFT (Electronic Funds Transfer) within 10-business days once bank account details have been provided. Claimants must ensure that all personal details provided are correct. Claimants are responsible for providing full and accurate bank account details including their full and accurate name. The Promoter will not be responsible for a banking institution rejecting an EFT payment, or any costs associated with locating any lost monies.

14. Every valid Claim received during the Claim Period will each be given their money back for the Eligible Product purchased, to the exact value of the product shown on the supplied purchase receipt scan up to a maximum of $39.16. For example, claimants that purchased a Depend Real Fit Incontinence Underwear Night Defence Men 8 Pack at $19.69 will receive a refund for $19.69. Claimants that purchased a Depend Real Fit Incontinence Underwear Regular Women 8 Pack at $18.33 will receive a refund of $18.33. 

15. Please allow approximately up to 20 business days from the time the Promoter validates the Claimant’s Claim form for payment of the refund amount to be made via EFT to the Claimants bank account (as per details provided in Clause 14).  

16. The refund amount cannot be transferred, exchanged for any other product, or claimed at point of purchase. 

Total refund offer pool: NZD$7,832. 

Changes to Offer 

17. If this offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: 

a) to disqualify any Claimant; or 
b) to modify, suspend, terminate or cancel the Offer, as appropriate.

18. The Promoter reserves the right, at any time, to verify the validity of Claims and Claimants’ details and to disqualify any Claimant who submits a Claim that is not in accordance with these Terms and Conditions or who, in the opinion of the Promoter, tampers with the Claim process.  Incomplete, indecipherable or illegible Claims will be invalid.

Liability

19. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Terms and Conditions excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees under any applicable law.

20. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) this Offer; (b) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (c) any theft, unauthorised access or third party interference; (d) any Claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) any variation in claim value to that stated in these Terms and Conditions; or (f) any tax liability incurred by a Claimant. 

21. Each refund will be awarded to the person named in the Claim form and any Claim that is made on behalf of any Claimant or by a third party will be invalid. If there is a dispute as to the identity of a Claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Claimant.

Privacy 

22. Claimants’ personal information will be collected by the Promoter. Personal information will be stored on the Promoter's and its related bodies corporates’ databases. The Promoter may, if the Claimant selects the respective opt-in on entry, use this information for future marketing purposes regarding its products where the Claimant has opted in, including contacting the Claimant electronically. The Promoter is bound by the New Zealand Privacy Principles in accordance with the New Zealand Privacy Act 2020(Cth) and its privacy policy which is located at https://www.global.kimberly-clark.com/en-nz/privacy. The Promoter's privacy policy contains information about how the Claimant may access, update and seek correction of the personal information the Promoter holds about them and how the Claimant may complain about any potential breach by the Promoter of the New Zealand Privacy Principles or any other New Zealand privacy laws and how such complaints will be dealt with. The Promoter collects personal information about Claimants to enable them to participate in this Offer and may disclose the Claimants' personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Offer. If the Claimant does not provide their personal information as requested, they may be ineligible to claim a refund in the Offer. Other

23. The Promoter has no control over communications networks or services, the internet, or computer or telephone networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. 

24. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.

25. Where Claims are allowed online, there is no additional cost to enter the Offer other than any cost paid by the Claimant to access the website platform via their Internet service provider.

26. The Promoter reserves the right, at any time, to: (a) validate and check the authenticity of Claims and Claimant's details (including a Claimant's identity, age and place of residence); and (b) request further information regarding proof of purchase from a Claimant. In the event that a Claimant cannot provide suitable proof as required by the Promoter to validate their Claim, the Claimant will forfeit the refund in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible Claims, as applicable, will at the Promoter's discretion be deemed invalid and not eligible for a refund. 

27. Claims containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible for a refund. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically claim repeatedly is prohibited and may render all claims submitted by that individual invalid.

28. The Promoter reserves the right to disqualify Claims in the event of non-compliance with these Terms and Conditions. In the event that there is a dispute concerning the conduct of the Offer or claiming a refund, the Promoter will resolve the dispute in direct consultation with the Claimant. If the dispute cannot be resolved the Promoter’s decision will be final.

29. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.

30. A reference in these Terms and Conditions or in any advertisement relating to this Offer to ‘dollars’ or $ is a reference to the lawful currency of New Zealand.
