Terms and conditions

1. Entry into this competition is deemed acceptance of these and any other applicable terms and conditions. This competition may have additional terms and conditions and wherever possible the additional terms and conditions will be posted at www.newworld.co.nz.

Promoters

2. The Promoters of this competition is Foodstuffs (N.Z.) Limited (‘Foodstuffs’). Mondelez New Zealand, 476 Rosebank Road, Avondale, Auckland 1026 is the prize supplier (‘Supplier’).

Promotion Period and how to enter

3. The competition commences on 19/02/24 and runs until close of trade on 31/03/24 (Promotion Period).

Eligible Purchase

4. You will receive one entry in the draw when you purchase any Cadbury Easter product during the Promotion Period and scan your Clubcard card instore at the time of payment, or when you enter your Clubcard details before the time of payment for online shopping purchases (Eligible Purchase) at all New World stores nationwide plus online at www.newworld.co.nz/shop and through the New World mobile application (Participating Stores).
When you make an Eligible Purchase you will automatically be entered into the draw.
5. You will only receive one entry into the competition even if you purchase multiple participating products in your Eligible Purchase.

Eligibility to enter and to win a prize

6. To be eligible to enter this competition and win a prize:
a) you cannot be an employee or contractor of a Participating Store or the Supplier;
b) you must have made an Eligible Purchase;
c) you must be a current Clubcard member;
d) you must be a New Zealand resident and 18 years of age or older;
e) you must consent to Foodstuffs using your name, photo, hometown and image for publicity and promotional purposes (including the display of your name in store) and you must make yourself available for publicity photographs relating to the competition on request for no additional compensation.
7. Entries which in the reasonable opinion of the Promoters:
a) are received outside the Promotion Period;
b) contain defamatory, offensive or inappropriate content or infringe intellectual property rights;
c) are incomplete or indecipherable; or
d) do not otherwise comply with these Terms and Conditions,
will be invalid and ineligible for any prize.

How winners will be selected

8. The prize winner will be drawn by Foodstuffs (or its agent) by 15/04/2024 by random electronic selection from all entries. The first 5 eligible winners drawn will each win one (1) trip package for four (4) people to a mystery destination organised by Wander Weekends (“Prize”). There are five (5) Prizes each worth up to
$5,200 NZD GST inclusive to be won. The total prize pool is valued at up to $26,000 NZD GST inclusive. Specific details about the Prize can be found at clause 12.

If prize becomes unavailable

9. Subject to any applicable law that cannot be excluded, the Promoters are not responsible or liable for any loss suffered by any entrant in the event that a prize becomes unavailable for reasons beyond its control. In this event, the Promoters may substitute a prize of their choice.

Notifying winners

10. Winners will be notified by Foodstuffs or the Supplier once a draw has been completed within 5 working days of the draw, via the contact details on record for the Clubcard used to enter the competition. In the event that a winner cannot be contacted within 5 working days of a draw occurring or if the Promoters determine that a winner is not eligible to participate in a draw the prize will be forfeited, a further draw will be conducted using the same eligibility criteria, and the prize allocated to the new winner.
11. The Promoters are not responsible if a winner cannot be contacted following the draw due to incorrect or out of date contact details being recorded in Clubcard’s system, and any such winner will forfeit the prize to the next eligible winner, on these Terms and Conditions.

Prize conditions

12. Each prize includes:
• boutique accommodation for 4 people – either twin share OR 2x separate hotel rooms/accommodation pods;
• return economy domestic flights, with 23kg baggage allowance;
• transfers OR rental car (Prize winner’s choice; car rental subject to availability and driver age and licence requirements);
• personalised Itinerary;
• local tips; and
• activity OR food (winner to choose between having food or activities supplied. Based on the winner’s preference, Wander Weekends will tailor one bigger activity OR multiple smaller activities to the winner’s interests, or organise meal(s), subject to availability. Restaurants will be booked based on the answers given by the Winner).

Wander Weekends’ Prize Terms

VALIDITY All bookings with Wander Weekends are made according to these terms and conditions.
PROVIDERS Please note Wander Weekends is not the travel provider, we are a travel agency who uses other providers and suppliers. Therefore, we are subject to the rules and regulations set by these providers (Airlines, Transfer Companies, Tours and Activities Suppliers, Hotel Providers. We sell a wide range of travel-related products and services, which can be from different providers (collectively, the “Providers”). Each Provider has its own terms and conditions that will be applicable as well to your Trip, in addition to our own terms and conditions.
ORDER ACCEPTANCE (a) The purchase of a trip by Wander Weekends constitutes a contractual agreement between you and all persons travelling with you on the same trip (collectively referred to as “You” and “Your”) and Wander Weekends and represents your acceptance of the Wander Weekends Terms & conditions. (b) You agree that your order is an offer to buy, under these Terms, the Trip listed in your order. All orders must be also accepted by us at our sole discretion, we may decide not to accept your order, even after we have sent you an email with your order number and details.
PRICING All prices are quoted in New Zealand currency and include tour preparation, operation costs and GST where applicable. Prices include what is outlined in each Wander Weekend package. Not included are meals not specified in the itinerary, drinks, laundry, optional activities and items of a personal nature.
CHANGES TO THE ITINERARY Wander Weekends reserves the right to alter or change accommodation, meal providers, carriers or vessels at any time for any reason; and cancel or alter the itinerary and/or tour at any time without notice, as we deem necessary for any valid reason whatsoever including road, weather or traffic conditions, non performance of suppliers, industrial action, operational conditions and requirements.
DISSATISFACTION, CANCELLATION AND REFUNDS By booking and paying for a Wander Weekend youare automatically agreeing to these Terms and Conditions. Once you have booked your package, Wander Weekends have authorisation from you to take full control of your trip, including but not limited to, flights, accommodation, activities, transportation and meals. Wander Weekends will not be retained liable if you are dissatisfied or unhappy with your trip. No refunds will be offered under these circumstances. There will be no refund for cancellation once travel has commenced or for any unused services.
If you can't travel due to unforeseen circumstances, we will aim to reschedule your weekend. A service fee of $250 per person in addition to travel service provider fees will be charged if your weekend is rescheduled. We make no guarantee that providers will offer postponement. We require at least 10 days notice to reschedule your weekend, after this we can not guarantee a postponement. Alternatively, you may choose to cancel your weekend. All cancellations must be made in writing to Wander Weekends with at least 10 days notice. Partial refunds are considered on a case by case basis. When we book your trip, we pay deposits and/or make payments in full to secure reservations therefore refunds are subject to the terms and conditions of the activities, transportation and accommodation providers through which your reservations are made. We make no guarantee or promises as to whether providers will issue a refund. A service fee of $250 per person in addition to travel service provider fees will be charged if a refund is issued or a Wander Weekend is rescheduled. Vouchers expire within one year of purchase and will not be refunded.
These change and cancellation fees reflect the reasonable, direct and indirect costs, time and effort incurred or involved in us providing booking and advisory services to you, as well as processing and managing the changes to, or cancellation of, your booking.
All bookings are made on your behalf subject to the terms and conditions imposed by the travel service provider. If, for example, a travel service provider’s terms and conditions contain a “no refund policy”, we will only be able to provide you with the remedy provided by the travel service provider (if any), which may include a travel credit supplied by the travel service provider.
You acknowledge that you are choosing to travel at a time where you may be exposed to COVID-19 and that your travel plans may be impacted by COVID-19. It is your own responsibility to acquaint yourself with all relevant travel information, including applicable health risks and travel restrictions (including (without limitation) border closures, isolation and quarantine requirements). You acknowledge that your decision to travel is made based on your own consideration of this information, and you acknowledge and agree that you are aware of, and assume responsibility for, all of the risks associated with traveling at this time. To the fullest extent permitted by law, we accept no liability in relation to any of these additional risks.
COVID19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is known to be contagious and spread from person-to-person contact and possibly by contact with contaminated surfaces and objects or in the air. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and death.
Wander Weekends cannot prevent travellers from becoming exposed to, contracting, or spreading COVID-19 while utilising Wander Weekends services or before your travel date. It is not possible to prevent against the presence of the disease. Therefore, if you choose to travel during the pandemic, you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.
By agreeing to these Terms of Use, you understand the above warning concerning COVID-19 and choose to accept the risk of contracting COVID-19 by travelling during a global pandemic. You accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilise Wander Weekends travel planning services. This also includes the risk of having to self-isolate at your destination at your own cost.
By agreeing to these Terms of Use, you release and waive the right to bring suit against Wander Weekends and its owners, officers, directors, managers, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilising Wander Weekends' services. You understand that this waiver means giving up the right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim to seek damages, whether known or unknown, foreseen or unforeseen.
We strongly recommend that you that you check your travel insurance to ensure it provides you with adequate protection.
In addition you should familiarise yourself with airline requirements around passenger safety, including the requirement for face masks and the need to produce evidence meeting airline and border control requirements in relation to a negative COVID-19 test or showing your MyVaccine passport. This information is subject to change without notice so we recommend you update yourself in relation to the government policies for New Zealand at each of (i) the time of booking, (ii) as you approach your travel date, and (iii) immediately before travel.
A service fee of $250 per person in addition to travel service provider fees will be charged if a Wander Weekend is rescheduled due to the impact of Covid 19.

CANCELLATION Full payment is due at time of booking via credit card. Once you have completed your booking, it is completely non-changeable.
TRAVEL INSURANCE We suggest that all travellers are covered by some form of travel insurance (including health insurance) and it is your responsibility to arrange such insurance. We can book insurance on request.
BAGGAGE ALLOWANCE Any Wander Weekend package that includes flights includes one piece of carryon bag per person not to exceed 7kg per person. Passengers are to ensure that luggage meets the weight requirements. If you would like a checked in piece of luggage you must advise us of this in your survey. There will be an additional charge to book a checked in bag.
AFTERSALE SERVICE (a) Wander Weekends is not responsible or liable if you miss your flight or activity due to incapability to show up on time. Any costs, expenses, of additional transportation, hotel accommodation or activities due to such a circumstance will be at your own expense.
(b) Any changes of flights, activities or tour dates, schedules, timings, durations, etc are not acceptable and by using our services you commit to show up at the indicated times and locations in order to be able to complete the itinerary. You can contact us prior to your departure in case any information or indication in the materials we provided isn’t clear or is missing.
FORCE MAJEURE Wander Weekends will not be liable or responsible nor be deemed to have defaulted or breached these Terms, for any failure or delay in our performance under these Terms when such failure or delay is caused by or results from circumstances or acts beyond our reasonable control, including (without limitation), acts of God, earthquake, flood, fire, explosion, terrorist acts, governmental actions, war, invasion or hostilities riot or other civil unrest, national emergency, epidemic lockouts, revolution, insurrection, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or telecommunication breakdown or power outage.
PRIVACY NOTICE Wander Weekends collect information about you, including health if necessary, to provide services and products to you, process your travel arrangements, and ensure efficient completion of your travels.
We may need to pass on this information to airlines, and other operators. We respect your privacy and are committed to protecting it, all personal data collected from you in connection with your purchase of products or services through Wander Weekends will be kept safe.
COMPANY LIABILITY Wander Weekends shall in no circumstances whatsoever be liable to the client or any person travelling with him/her, for death, personal injury, sickness, accident, loss or any misadventure howsoever caused; any act, omission, default of any hotelier, carrier or other person or by servant or agent employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility or service for client, or any person travelling with him/her howsoever caused; the temporary or permanent loss of or damage to baggage or personal effects howsoever caused.
RENTAL CAR As part of your trip, we might book a car rental for you, in case your final destination isn’t easily reachable from the nearest airport, in order to give you a bit more freedom of your movements during your weekend. For this reason, we kindly ask you to let us know in the survey if you have a valid New Zealand driving license and if you’re willing to be driving. You must be over the age of 18 to have a rental car included in your package. Full insurance for your rental car is included. You will be responsible to pay your own excess, should you be required to make a claim through this insurance. You may need to provide a credit card when collecting the rental car. You are responsible to ensure you return the car with a full tank. If you fail to do so, you will be charged for this cost.
SELF DRIVE If you have booked our Local Wanderer package where you are required to use your own vehicle, you are responsible for ensuring your car has a current Warrant of Fitness, registration, drivers licence and insurance. Wander Weekends will not be liable for any charges relating to your vehicle. You are also responsible to cover the cost for your fuel.
DAMAGES You are liable if any damages that are incurred during the stay at your accommodation. Wander Weekends will charge you for any damages.
13. Prize winner(s) must redeem their prize by 15/04/2025.
14. Prizes are not transferable, exchangeable or negotiable and are not redeemable for cash.
15. The prize draw results are final and no correspondence will be entered into.
16. Winners can only be awarded one prize. If a winner is drawn for any additional prize, the prize will be forfeited, a further draw will be conducted, and the prize allocated to the new winner.
Verifying compliance with these terms
17. The Promoters reserve the right to verify the identity of any entrant (including an entrant's identity, age, city/town of residence and place of employment) and to verify the validity of entries and to disqualify any entry or refuse to award a prize where false or misleading details have been given by an entrant, or an entrant has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these Terms and Conditions.

Exclusion of liability

18. Subject to any applicable laws which cannot be excluded, Foodstuffs, any Participating Store, the Supplier, and their respective employees and agents will not be liable for any loss, damage or injury of any nature incurred or suffered by any person (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with this competition or with winning, redeeming or benefiting from the prize.

Disputes

19. In the event of a dispute concerning any aspect of the competition including eligibility the decision of the Promoters will be final. No correspondence concerning any decision made by the Promoters will be entered into.

Additional terms

20. In addition to these Terms and Conditions, terms and conditions of your Clubcard will also apply and can be viewed at www.clubcard.co.nz.
21. The Promoters reserve the right to amend, suspend or terminate the competition and these Terms and Conditions at any time.
22. Entries remain the property of the Promoters. Entrants license and grant the Promoters, their affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display any content submitted in or with the entry for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability. Entrants consent to any dealings with their entry that may otherwise infringe any moral rights in the entry, to the extent permitted by law.
23. By submitting content as part of an entry to the competition, entrants release the Promoters, their respective employees, directors and officers from any and all liability for use and publication of the content, including any such liability that may arise under patent, trademark, copyright, or any other applicable law. Entrants warrant that the content is their original work, that they are the sole author, and that they are able to provide the licence and releases required under these terms and conditions.

Privacy

24. Your personal information may be used to conduct this competition and for future promotional and publicity purposes in relation to this competition. By entering this competition, you consent to the use of your personal information for these purposes and we may use your personal information in accordance with these Terms and Conditions. Foodstuffs’ New World Privacy Policy will apply to all personal information that Foodstuffs collects from you.
