Terms and conditions

1. Entry into the Monster Energy V8’s Bathurst VIP Experience (Promotion) is deemed acceptance of these and any other Clubcard terms and conditions.This Promotion may have additional or amended terms and conditions and wherever possible the additional terms and conditions will be posted at www.newworld.co.nz. 

Promoter

2. The Promoters of this Promotion are Foodstuffs (N.Z.) Limited (Foodstuffs) and Coca-Cola Europacific Partners New Zealand Limited, The Oasis, Mt Wellington, Auckland (CCEP), jointly the Promoters.

3. Monster Energy AU Pty Ltd is not the promoter of the Promotion.The Monster Energy brand names, logos and/or materials are used for the purposes of Promotion and/or the Prize (as defined below) details only and such use is not intended to suggest or imply Monster Energy AU Pty Ltd’s sponsorship of this Promotion. 

Eligibility to enter and to win a prize

4. To be eligible to enter this Promotion and win the Prize (as defined below):

a) you cannot be a New World or Clubcard staff member or management, employee, director or contractor of the Promoters and their related body corporates, the participating stores or other agencies, firms or companies associated with the Promotion (including suppliers of the prizes); 

b) you must have made an Eligible Purchase (as defined below) and scanned (or entered online) your Clubcard at the time of purchase;

c) you must be 18+ years of age and a New Zealand resident;

d) you must be a current Clubcard member; 

e) you must consent to the Promoters using your name, photo, hometown and image for publicity and promotional purposes (including the display of your name in store) and you must make yourself available for publicity photographs relating to the Promotion on request for no additional compensation. 

Promotion Period 

5. The Promotion commences at 12.00am on 22nd August 2022 and runs until 11.59pm on 11th September 2022 (Promotion Period).

Eligible Purchase and how to enter 

6. During the Promotion Period, you will be automatically entered into the Prize draw each time you purchase any 2 (two) Monster Energy® 500mL products or 1 (one) 500mL four pack (including all 500ml variants but excluding vending machine purchases) in one transaction from any participating New World Supermarket or online at www.newworld.co.nz/shop and scan your Clubcard instore at the time of payment, or when you enter your Clubcard details before the time of payment for online purchases (Eligible Purchase). For the purpose of this Promotion, participating stores refer to all New World stores nationwide and online at www.newworld.co.nz/shop, including Shoprite Inglewood but excluding Fresh Collective by New World stores (Participating Stores). 

7. Entries will not be accepted on a retrospective basis after the time of purchase.

8. You are able to enter the Prize draw more than once in separate transactions. However, you will only receive one entry into the Prize draw even if you purchase more than two participating products in one transaction.

9. If an entry is made by a secondary Clubcard holder scanning that Clubcard, the entry will be made in the name of the primary holder of the Clubcard. 

Prize conditions

10. The Prize is a Monster Energy V8’s Bathurst VIP Experience for two (must be 18+). 

This Prize package is comprised of:

a) Two return economy international flights (including baggage) from the winner’s closest New Zealand International Airport to Sydney, Australia, departing Thursday 6th October 2022 and returning Monday 10th October 2022, up to a total of $2000NZD.
b) Return airport transfers from Sydney Airport to Bathurst; 
c) 5 Nights’ accommodation for two people, sharing one hotel room, in Bathurst with a value of up to $4200NZD. Bookings will be made on behalf of the winner by the promoter;
d) $1,000NZD spending money for the winner only;
e) Two ASM Corporate Suite passes to Bathurst.

11. The estimated total Prize value is up to $20,000NZD. 

12. Additional transfers to those specified and any Ground Operator Handling Fees are not included.The winner and his/her companion are responsible for all other expenses including meals, drinks, laundry charges, activities (unless specified), car hireage, hotel incidentals and in room charges, service charges, gratuities and additional taxes. Unless expressly stated in these terms and conditions all other travel and prize related expenses become the responsibility of the winner and his/her companion. 

13. Travel insurance is not included. Selection of airline, departure times and accommodation venue are at the Promoter’s discretion at the time of booking. The winner is responsible for any vehicle hire and insurance during the Prize dates. Airline travel, and accommodation are subject to the relevant supplier’s standard terms and conditions and the Promoter will not be liable for any act or omission of any third party providing those services. 

14. The Prize must be taken as offered and may not be deferred, is not transferable, and may not be exchanged for cash or taken in parts. Cost for changes made by the winner (or their companion) to the Prize after it has been booked must be paid by the winner (or their companion).The winner will be required to present a valid credit card when checking in to the accommodation.

15. Prior to being awarded the Prize, the winner and his/her companion will be required to:
a) Show proof of their identity and a valid NZ Passport; and to the fullest extent permitted by law, sign a “Participation Agreement” in the form required by the Promoter, confirming acceptance of these terms and conditions, relating to the Prize, releasing the Promoter, its officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising and promotional agencies from any and all liability in connection with this Promotion.

b) If the Participating Agreements are not signed by the winner and his/her companion and returned to the Promoter within three (3) business days of receiving the Participation Agreements documents, the Prize will be forfeited and redrawn.  You will be given a reasonable opportunity to review and consider the Participation Agreement before signing.

16. It is the responsibility of the winner and his/her companion to ensure that they have full and correct travel documentation, including but not limited to valid passports and visas which meet the requirements of immigration and other government authorities at the destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the winner and his/her companion.  

17. It is the responsibility of the winner and his/her companion to meet any health and safety requirements applicable to the Prize (for example, in relation to COVID-19), including (but not limited to) obtaining any pre-departure tests or checks, or any other requirements, such as performing and returning negative COVID-19 tests, as may be required by third parties from time to time.  

18. The Prize illustrated on any point-of-sale materials and social media images are not indicative of the exact Prize.

19. If any Prize element is unavailable, despite the Promoter’s reasonable endeavours to procure it, the Promoter reserves the right to substitute a different prize of equal or greater cash value. 

20. If the Prize winner does not wish to claim a Prize,they may nominate another person to whom their Prize can be transferred. However, the Prize must not be sold or used, donated or given away as part of another promotion. 

21. Without limiting any other term of these Terms and Conditions, all elements of the Prize must be taken as and when specified, or will be forfeited with no replacement. The estimated Prize values include any applicable GST. The Promoter is not responsible for any change in Prize value.  

22. The Prize is not transferable, exchangeable or redeemable for cash.

How the winner will be selected

23. The Prize winner will be drawn by Loyalty New Zealand Limited (Loyalty) on behalf of the Promoters  on 26th  September 2022 by random electronic selection from all valid entries received during the Promotion Period. The first eligible winner drawn will win.

24. Subject to any applicable law that cannot be modified or excluded, the Promoters are not responsible or liable for any loss suffered by any entrant in the event that a Prize (or any part of it) becomes unavailable for reasons beyond its reasonable control. In this event, the Promoters reserve the right to substitute the Prize (or a part of it) for a prize of equal or greater cash value.

Notifying winner

25. The winner will be notified by one or both of the Promoters once the draw has been completed within 3 working days of the draw, via the contact details on record for the Clubcard used to enter the Promotion (or the primary Clubcard holder if a secondary card was used). In the event that a winner cannot be contacted within 3 working days of a draw occurring or if the Promoters determine that a winner is not eligible to participate in a draw, the Prize will be forfeited. A further draw will be conducted, and the Prize allocated to the new winner.

26. The Promoters are not responsible if a winner cannot be contacted following the draw due to incorrect or out of date contact details being recorded in the Clubcard’s system, and any such winner will forfeit the Prize to the next eligible winner, on these Terms and Conditions.

Verifying compliance with these terms

27. The Promoters reserve the right to verify the identity of any entrant (including an entrant's identity, age, city/town of residence and place of employment) and to verify the validity of entries and to disqualify any entry or refuse to award the Prize where false or misleading details have been given by an entrant, or an entrant has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these Terms and Conditions. 

Exclusion of liability

28. Subject to any applicable laws which cannot be excluded, the Promoters (jointly or severally), any Participating Store, their respective employees and agents will not be liable for any loss, damage or injury of any nature incurred or suffered by any person arising directly or indirectly out of or in connection with the Promotion or with claiming/winning, redeeming or benefiting, or availing themselves, from the Prize.

29. If the Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoters, including but not limited to, infection by computer virus, bugs, tampering, unauthorised intervention, acts or omissions of third parties, technical failures, governmental restraint, order or regulation or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoters reserve the right, in their sole discretion, to cancel, terminate, modify or suspend the Promotion. Any cancellation, termination, modification or suspension of the Promotion will be notified on the New World website at www.newworld.co.nz 

Disputes

30. In the event of a dispute concerning any aspect of the Promotion including eligibility, the decision of the Promoters will be final. No correspondence concerning any decision made by the Promoters will be entered into. 

Additional terms

31. In addition to these Terms and Conditions, the Clubcard terms and conditions will also apply and can be viewed at www.clubcard.co.nz. The winner has rights under the New Zealand Consumer Guarantees Act 1993 which cannot be excluded or limited by the Promoters. These rights include statutory guarantees that any goods provided by the Promoters will be of acceptable quality and fit for purpose, and that any services provided by the Promoter will be rendered with due care and skill. These terms and conditions do not, and do not intend to, exclude or limit those statutory rights in any way. However, to the extent that is permitted by law to do so, the Promoters makes no representations or warranties, express or implied, under laws other than the Consumer Guarantees Act 1993 regarding the quality or suitability of the Prize awarded as part of this Promotion and will not be responsible for breach of such representations or warranties.  

32. If any of these Terms and Conditions are determined to be illegal, invalid or otherwise unenforceable, then the remaining terms and conditions shall continue in full force and effect.

33. The Promoters’ failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that or any other provision by the Promoters.

34. Any tax which the winner may be required to pay on the Prize under New Zealand law or the law of any other jurisdiction shall be the responsibility of the winner. The Promoters are not responsible for any tax implications arising from you winning the Prize.  You should seek independent financial advice.

35. These Terms and Conditions are governed by the laws of New Zealand.

Privacy

36. All entries remain the property of Foodstuffs. All personal information will be collected and stored by Foodstuffs and Loyalty in accordance with the Privacy Act 2020 and the privacy policy available at https://www.newworld.co.nz/privacy-policy. You have the right to access your personal information and request correction of any errors in it pursuant to the Privacy Act 2020. Entrants' personal information may be used to conduct this Promotion and for future promotional and publicity purposes in accordance with the Clubcard terms and conditions. By entering this Promotion entrants consent to the use of their information as described above.
